Terms of Service

These Terms of Service ("Terms") govern your access to and use of ForkTasker, a service operated by Ztech Digital Technologies LLC ("Company", "we", "our", or "us"), a limited liability company registered in the State of Florida. By creating an account or using the ForkTasker service, you agree to be legally bound by these Terms.

Please read these Terms carefully before using the service. If you do not agree to these Terms, you may not access or use ForkTasker.

1. Definitions

In these Terms, the following expressions have the meanings assigned to them:

"ForkTasker" refers to the AI-powered meal planning application and associated website operated by Ztech Digital Technologies LLC, accessible at forktasker.com and app.forktasker.com.
"Service" means the ForkTasker application, website, Chef AI assistant, meal planning tools, recipe database, grocery integration features, and any other features or content provided by us.
"User" or "you" means any individual who creates an account, accesses, or uses the Service.
"Content" means all text, recipes, meal plans, nutritional information, images, recommendations, and other material generated or displayed by the Service, including AI-generated content.
"AI-Generated Content" means any meal plans, recipe suggestions, shopping lists, pantry recommendations, or chat responses generated by the Chef AI assistant powered by Anthropic's Claude AI.
"Subscription" means a recurring paid plan (Basic or Premium) that grants access to certain features of the Service.
"AI Credits" means prepaid credit balances that can be purchased and used to extend AI feature access beyond the monthly included amount.
"Trial" means the free 7-day trial period offered to new users upon account creation.
"Third-Party Services" means external platforms integrated with ForkTasker, including but not limited to Stripe (payments), Anthropic (AI processing), Instacart, and Walmart (grocery integrations), and Resend (email delivery).

2. Acceptance of Terms

By creating an account, clicking "I agree," checking the acceptance checkbox at registration, or otherwise accessing or using the Service, you confirm that you have read, understood, and agree to be legally bound by these Terms, including all terms incorporated by reference. You also represent that you are a resident of the United States. If you are located outside the United States, you may not use the Service — see Section 22.

If you are accepting these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.

We maintain a record of the date and version of these Terms that you accepted at the time of account creation. This record constitutes binding evidence of your agreement.

3. Age Requirements

You must be at least 18 years of age to create an account or use the Service. By registering, you represent and warrant that you are 18 or older. ForkTasker is not directed to, and does not knowingly collect information from, anyone under the age of 18. If we become aware that a user is under 18, we will promptly close their account and delete their associated data.

If you are between 13 and 17 years of age, you may only use the Service with the documented consent and active supervision of a parent or legal guardian, who must agree to these Terms on your behalf and assume full responsibility for your use of the Service. The dietary and allergen disclaimers in Section 6 apply with particular importance to minors.

4. Description of Service

ForkTasker is an AI-powered meal planning platform that helps users plan weekly meals, discover recipes, manage their pantry, and build grocery shopping carts. Key features include:

An AI Chef assistant ("My Chef") that generates personalized meal plans and answers meal-related questions using Anthropic's Claude AI.
Access to a curated database of recipes sourced from third-party datasets.
Pantry management tools including photo scanning and receipt scanning.
Grocery cart building that pre-fills carts on Instacart and Walmart.
Email delivery of meal plans and shopping lists.
Custom recipe management and import tools.

The Service is provided on a subscription basis with a free trial tier. Features available depend on your current subscription plan.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time without prior notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.

5. AI-Generated Content

ForkTasker uses artificial intelligence to generate meal plans, recipe suggestions, and nutritional estimates. AI-generated content is not reviewed by registered dietitians, nutritionists, or medical professionals before delivery to you. You should not rely on AI-generated content as a substitute for professional dietary or medical advice.

How AI is used

The Chef AI assistant and Smart Plan features are powered by Anthropic's Claude AI model. When you interact with My Chef, request a meal plan, or upload photos for pantry or receipt scanning, your input is processed by Anthropic's API. Please review Anthropic's Privacy Policy for details on how they handle data.

Accuracy and limitations

AI-generated meal plans, recipe recommendations, nutritional estimates, ingredient lists, and shopping suggestions are generated algorithmically and may contain errors, inaccuracies, or omissions. We do not guarantee the accuracy, completeness, or suitability of any AI-generated content for your specific dietary needs, health conditions, or food preferences.

In particular:

Calorie counts and nutritional values displayed are estimates and may not reflect actual values.
Ingredient quantities in AI-generated plans may require adjustment based on your household size and preferences.
The AI may occasionally suggest ingredients, combinations, or cooking techniques that require verification before use.
AI output is non-deterministic — the same request may yield different results at different times.

Not a substitute for professional advice

ForkTasker is a meal planning convenience tool, not a medical, clinical, or dietetic service. No content generated by ForkTasker, including AI-generated meal plans, constitutes professional dietary, nutritional, or medical advice. Users with specific health conditions, chronic diseases, eating disorders, pregnancy, or other medical needs should consult a licensed healthcare provider or registered dietitian before making significant dietary changes.

Model changes

The AI capabilities of the Service are provided through Anthropic's Claude API. We are not responsible for changes in the behavior, output quality, or availability of the underlying AI model. Anthropic may update or modify the model at any time, which may affect the nature of AI-generated content.

6. Dietary and Allergen Disclaimer

ForkTasker does not verify the allergen content, ingredient accuracy, or nutritional safety of any recipe. If you have food allergies, intolerances, or medical dietary requirements, you are solely responsible for reviewing every recipe and ingredient before preparation and consumption.

Recipe database accuracy

Recipes in the ForkTasker database are sourced from third-party datasets and have not been individually verified by our team. Recipe metadata including cuisine classification, dietary tags, allergen flags, and nutritional information may contain errors. We make no warranty that any recipe is free of any specific allergen, ingredient, or dietary component.

Your responsibility

You acknowledge and agree that:

You are solely responsible for determining whether any recipe, meal plan, or ingredient list is appropriate for your dietary needs, health conditions, and allergies.
You must independently verify all allergen information before preparing or consuming any recipe suggested by ForkTasker.
Dietary tags such as "gluten-free," "dairy-free," "vegan," or "nut-free" are sourced from recipe metadata and are not independently verified by ForkTasker. Cross-contamination risk and labeling accuracy are your responsibility to assess.
You should consult a physician or registered dietitian before beginning any significant dietary program, particularly if you have a personal or family history of food allergies, chronic illness, heart disease, diabetes, obesity, digestive conditions, or if you are pregnant or breastfeeding.
Recipes and meal plans are not formulated to address nutrient deficiencies, clinical dietary requirements, or therapeutic dietary needs.

No medical advice

Nothing in the Service, including AI-generated meal plans, recipe suggestions, or nutritional estimates, constitutes medical or clinical nutrition advice. The Service is not monitored or controlled by medical professionals. If you have concerns about your health or dietary needs, always consult a qualified healthcare provider. In a medical emergency, call emergency services immediately.

7. Subscriptions and Billing

Subscription plans

ForkTasker offers subscription plans (Basic and Premium) that provide access to additional features beyond the free trial. Current pricing is displayed on the ForkTasker website. All subscription fees are charged in U.S. dollars.

Automatic renewal

Subscriptions automatically renew at the end of each billing cycle (monthly or annually, as selected) unless you cancel before the renewal date. By subscribing, you authorize us (through our payment processor, Stripe) to charge your payment method on a recurring basis for the applicable subscription fee until you cancel.

Payment processing

All payments are processed by Stripe, Inc. ForkTasker does not store, access, or have visibility into your full payment card number or card security code. By subscribing, you agree to Stripe's Terms of Service. Payment disputes and chargebacks are governed by Stripe's policies and your card issuer's terms.

Price changes

We reserve the right to change subscription pricing at any time. We will provide at least 30 days' notice of any price increase before it takes effect. Continued use of the Service after a price change takes effect constitutes your acceptance of the new pricing.

Cancellation

You may cancel your subscription at any time through the billing portal accessible from your Profile tab in the app. Cancellation takes effect at the end of the current billing period — you will retain full access to your plan's features until that date. We do not issue prorated refunds for unused portions of a billing period.

Failed payments

If a payment fails, we will make up to three retry attempts over a short period. If all retries fail, your subscription will be downgraded and your access to paid features will be suspended until the payment issue is resolved.

8. Free Trial Terms

New users receive a free trial upon account creation with the following limits:

Duration: 7 calendar days from account creation.
AI actions: 5 AI actions (each use of My Chef, meal plan generation, pantry photo scan, or receipt scan counts as one action).
Independent limits: The 7-day time limit and the 5 AI action limit are independent. Exhausting your AI actions does not end your trial — you retain access to non-AI features (recipe browsing, manual plan building, pantry management) for the full 7 days. Exhausting your trial period ends all access regardless of remaining AI actions.

At the end of the trial period, you must subscribe to continue using the Service. No credit card is required to start a trial; payment information is only collected when you choose to subscribe.

We reserve the right to modify trial terms, duration, or included features at any time without notice.

9. AI Credits and Bonus Credits

Premium subscribers receive a monthly AI usage allowance. Users who exceed their monthly allowance may purchase additional AI Credits to extend access.

Non-refundable: AI Credits are non-refundable under any circumstances once purchased, including upon cancellation or account termination.
No cash value: AI Credits have no cash value, cannot be transferred to another account, and cannot be exchanged for any monetary consideration.
Carry-over: Unused bonus AI Credits (purchased separately) carry over month to month and do not expire for as long as your account is active.
Monthly reset: The included monthly AI allowance resets on your billing date each month. Unused included allowance does not carry over.
Pricing changes: We reserve the right to adjust the AI Credits pricing or the amount of AI activity each dollar of credit provides, based on changes to underlying AI API costs. We will provide reasonable notice of material changes.
Expiration on account closure: Any unused AI Credits are forfeited upon account deletion or termination for cause.

10. Refund Policy

We generally do not issue refunds for subscription fees once a billing period has begun. However, we offer a limited refund window for first-time subscribers:

First-payment refund: If you subscribe for the first time and request a refund within 7 calendar days of your initial payment, and you have not used any AI features or created any meal plans during that period, we will issue a full refund of that payment. To request a refund, contact support@forktasker.com within the 7-day window with the subject line "Refund Request."

Refunds will not be issued if:

More than 7 calendar days have passed since the initial payment.
You have used any AI feature (My Chef, Smart Plan, pantry scan, receipt scan, recipe photo import) during the subscription period.
You have created any meal plans during the subscription period.
The request is for any renewal payment (only the first subscription payment is eligible).

AI Credits are non-refundable under any circumstances. Refunds are processed through Stripe and may take 5–10 business days to appear on your statement.

11. Third-Party Grocery Integrations

Instacart

ForkTasker offers a feature that builds a pre-filled grocery cart on Instacart based on your meal plan's ingredient list. This feature is provided as a convenience. When you use the Instacart cart feature, ingredient data from your meal plan is sent to Instacart via a third-party integration. You complete any grocery purchase directly on the Instacart platform, which is subject to Instacart's Terms of Service and pricing.

ForkTasker is not affiliated with, endorsed by, or a partner of Instacart. We are not responsible for Instacart's product availability, pricing, delivery, substitutions, or any aspect of the transaction between you and Instacart.

Walmart

ForkTasker offers a feature that builds a pre-filled cart on Walmart.com based on your meal plan's ingredient list, using the Walmart Affiliate API. When you use the Walmart cart feature, ingredient queries are sent to Walmart's API to match products and generate a cart link. You complete any purchase directly on Walmart's platform, which is subject to Walmart's Terms of Use.

ForkTasker participates in the Walmart Affiliate Program. We may receive a commission if you complete a qualifying purchase through a cart link generated by ForkTasker.

ForkTasker is not responsible for Walmart's product availability, pricing, regional inventory differences, product matching accuracy, cart contents, or any aspect of the transaction between you and Walmart. Cart content is generated algorithmically and may not match your exact ingredients — always review your cart before purchase.

General third-party disclaimer

Third-party platforms integrated with ForkTasker (Instacart, Walmart, Stripe, Anthropic, Resend, and others) are operated independently. Their terms of service, privacy policies, and practices govern your use of their platforms. We are not responsible for the actions, omissions, outages, or data practices of any third-party service. The availability of third-party integrations may change at any time without notice.

12. Intellectual Property and License

Our intellectual property

The ForkTasker application, website, design, graphics, user interface, source code, recipe curation, and all content we create or compile are the exclusive intellectual property of Ztech Digital Technologies LLC and are protected by copyright, trademark, and other applicable laws.

The name "ForkTasker," the ForkTasker logo, and any associated marks may not be copied, imitated, or used — in whole or in part — without our prior written permission.

License grant to you

Subject to your compliance with these Terms and maintenance of an active account in good standing, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for your personal, non-commercial meal planning purposes. This license does not include the right to:

Copy, reproduce, distribute, publish, or commercially exploit any Content from the Service.
Resell, sublicense, or make the Service available to third parties.
Modify, create derivative works from, reverse engineer, or decompile any part of the Service.
Remove or alter any copyright, trademark, or proprietary notices.
Use the Service or its Content to develop or train a competing product or service.

Recipe content

Recipes in the ForkTasker database are sourced from third-party datasets. Recipe creators and original authors retain their respective rights. ForkTasker does not claim ownership of individual recipes from third-party sources.

13. AI Training Prohibition

You may not use any Content, AI-generated output, meal plans, recipe data, or other material obtained through ForkTasker to train, fine-tune, evaluate, or otherwise develop machine learning models, artificial intelligence systems, or competing applications. This prohibition applies whether the use is commercial or non-commercial and regardless of the intended purpose of the model or system being trained.

Automated scraping, crawling, or extraction of Content from the Service for any purpose — including AI training, competitive analysis, or data aggregation — is strictly prohibited without our prior written consent.

14. User-Uploaded Content

Certain features of the Service allow you to upload photos and images, including pantry photos, grocery receipt photos, and recipe images. By uploading content to ForkTasker:

You grant Ztech Digital Technologies LLC a limited, royalty-free license to process, transmit, and use that content solely to provide the requested feature (e.g., pantry scan, receipt parsing, recipe import). This license is limited to the duration of the processing request and does not extend to any other use.
You represent that you own or have the right to upload the content and that it does not infringe any third-party rights.
Photos are not retained by ForkTasker beyond the duration of a single processing request and are not used for any purpose other than fulfilling your request.
You agree not to upload images that contain personal information about third parties without their consent, or any content that is illegal, obscene, defamatory, or otherwise objectionable.

15. Account Terms

One account per person: Each account is created for and may only be used by a single individual. Accounts may not be transferred or sold.
Account security: You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Do not share your password with any third party.
Accurate information: All information you provide during registration and account use must be truthful and accurate. You agree to keep your account information up to date.
Unauthorized access: If you suspect unauthorized access to your account or a security breach, you must notify us immediately at support@forktasker.com.
Account sharing: Account sharing (allowing others to use your login) is prohibited and may result in immediate termination of your account without refund.

16. Acceptable Use

You agree not to use the Service to:

Violate any applicable law, regulation, or these Terms.
Impersonate another person or entity or misrepresent your affiliation with any person or entity.
Attempt to gain unauthorized access to any part of the Service, other user accounts, or our systems.
Introduce viruses, malware, Trojan horses, or other harmful code into the Service.
Conduct security testing, scanning, or penetration testing on the Service without our prior written authorization.
Place a disproportionately large load on our infrastructure or interfere with the normal functioning of the Service.
Use automated scripts, bots, or crawlers to access or interact with the Service.
Create accounts under false pretenses or through automated means.
Use the Service in a manner that could harm us, our users, or third parties.
Circumvent, disable, or interfere with security-related features of the Service, including AI usage caps, tier restrictions, or payment enforcement.

We reserve the right to investigate suspected violations and take any action we deem appropriate, including removal of content, suspension, or termination of accounts, with or without notice.

17. Termination

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without cause or notice, including but not limited to:

Violation of these Terms or any applicable law.
Conduct that we determine, in our sole discretion, to be harmful to the Service, other users, or our business.
Non-payment of subscription fees.
Fraudulent activity or attempts to circumvent payment or usage limits.

You may delete your account at any time by contacting support@forktasker.com. Upon account deletion, your data will be retained for 90 days (to allow reinstatement) and then permanently deleted, as described in our Privacy Policy.

Upon termination, your license to use the Service ceases immediately. Sections of these Terms that by their nature should survive termination (including Sections 12, 13, 18, 19, 20, 21, and 22) will survive.

18. Limitation of Liability

To the fullest extent permitted by applicable law, Ztech Digital Technologies LLC, its officers, employees, agents, and licensors are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including loss of profits, data, goodwill, or other intangible losses — arising from your use of or inability to use the Service.

Our total aggregate liability to you for any claim arising out of or relating to these Terms or the Service — regardless of the form of action — is limited to the total fees you paid to ForkTasker in the twelve (12) months preceding the event giving rise to the claim, or one hundred dollars ($100), whichever is greater.

This limitation applies regardless of whether the damages are based on contract, tort (including negligence), strict liability, or any other legal theory, and even if we have been advised of the possibility of such damages.

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages. In such jurisdictions, our liability is limited to the fullest extent permitted by law.

Specifically, we are not liable for:

Any health outcomes, allergic reactions, or adverse effects resulting from following AI-generated meal plans or recipes.
Any inaccuracies in recipe content, nutritional information, or allergen data.
Any failure, error, or interruption in third-party services (Instacart, Walmart, Stripe, Anthropic, Resend).
Any unauthorized access to your account resulting from your failure to maintain password security.
Any loss of data due to service outages, server failures, or other technical issues.
Cart building errors, incorrect product matching, pricing inaccuracies, or purchases made on Instacart or Walmart.

19. Indemnification

You agree to defend, indemnify, and hold harmless Ztech Digital Technologies LLC and its officers, directors, employees, agents, and licensors from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

Your use of or access to the Service.
Your violation of these Terms.
Your violation of any applicable law or regulation.
Your violation of any third-party rights, including intellectual property rights.
Any health-related claim arising from your reliance on AI-generated meal plans, recipe content, or nutritional information provided by the Service.
Content you upload to the Service.

20. Dispute Resolution and Arbitration

Informal resolution first

Before initiating any formal dispute proceeding, you agree to contact us at support@forktasker.com with a written description of your dispute and your requested resolution. We will attempt to resolve the dispute informally within 30 days. Many issues can be resolved quickly through direct communication.

Binding arbitration

If informal resolution is unsuccessful, any dispute, claim, or controversy arising out of or relating to these Terms or the Service — including questions about whether a dispute is arbitrable — shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, as modified by these Terms. The arbitration shall be conducted in the State of Florida. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Small claims exception

Notwithstanding the above, either party may bring an individual claim in small claims court if the claim qualifies and remains in small claims court throughout the proceeding.

Costs

Each party shall bear its own costs and attorneys' fees in arbitration, except that the arbitrator may award costs and fees to the prevailing party if the arbitrator determines that a claim was frivolous or brought in bad faith.

Time limitation

Any claim arising out of or relating to these Terms or the Service must be brought within one (1) year of the date on which the cause of action accrued, or it is permanently barred.

21. Class Action Waiver

You and Ztech Digital Technologies LLC each agree that any dispute resolution proceedings — whether in arbitration or court — will be conducted only on an individual basis, and not as a class, consolidated, or representative action. You waive any right to participate as a class representative or class member in any class action lawsuit or class-wide arbitration relating to the Service or these Terms.

If a court or arbitrator finds that this class action waiver is unenforceable for any reason, then the arbitration agreement in Section 20 shall not apply to that claim, and such claim shall be brought in a court of competent jurisdiction in the State of Florida.

22. Governing Law and Geographic Scope

Geographic scope

ForkTasker is intended for use by residents of the United States only. By creating an account or using the Service, you represent and warrant that you are a resident of the United States. If you are located outside the United States, you are not authorized to use the Service and must not create an account or access the Service.

We make no representation that the Service is appropriate, lawful, or available for use in any location outside the United States. Users who access the Service from outside the United States do so at their own risk and are solely responsible for compliance with any applicable local laws. We expressly disclaim any liability arising from your use of the Service in violation of this geographic restriction.

We reserve the right to restrict access to the Service from any geographic region at any time, without notice, including through technical means such as IP-based filtering.

Governing law

These Terms and any dispute arising out of or relating to them or the Service shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.

To the extent any dispute is not subject to arbitration under Section 20 or the small claims exception, you consent to the exclusive jurisdiction of the state and federal courts located in the State of Florida for resolution of such disputes.

23. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

Updating the "Last updated" date at the top of this page.
Sending an email notice to your registered email address at least 30 days before material changes take effect (where feasible).
Displaying a notice within the app.

Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service and cancel your subscription before the effective date of the changes.

If our business is acquired by or merged with another company, these Terms and the rights and obligations herein may be assigned to the new entity. You will be notified of any such transfer.

24. Privacy Policy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By accepting these Terms, you also accept our Privacy Policy. Please review it to understand our data practices, including what information we collect, how we use it, and your rights.

26. Severability and Entire Agreement

Severability: If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, without affecting the validity and enforceability of the remaining provisions.

Entire agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Ztech Digital Technologies LLC regarding your use of the Service and supersede all prior agreements, representations, and understandings of any kind relating to the Service.

No waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorized representative of Ztech Digital Technologies LLC to be effective.

Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.
